All Specialty Trust Deeds are prepared on an individual basis but samples can be provided.

1. Confirmatory Trust Deed

This type of Trust Deed is suitable for those who have lost their trust deed and have exhausted all other options. A Confirmatory Trust Deed confirms the existence of a previously declared Trust and provides a standard set of clauses under which the Trust can operate. This is accompanied by a set of Statutory Declarations to be completed by the Trustees. Stamp Duty is not payable as no new Trust is declared.

This is available for both Family and Unit Trusts. 

 2. Charitable Trust Deed

A Charitable Trust is set up with a charitable cause as the beneficiary rather than specific persons or entities. Also known as Ancillary Funds, all distributions from the Trust must be paid for the benefit of the nominated cause.

These are available as either:

  • A Public Fund Charitable Trust, which is designed to receive funds from the public for a specific cause. These Charitable Trusts are also known as Public Ancillary Funds (PAF) and are eligible to apply for Deductible Gift Recipient (DGR) status and receive the corresponding Tax concessions, or
  • A Private Fund Charitable Trust (or Foundation), which is designed to receive private funds to be contributed to an existing Charity or Charities that in turn may have DGR Status. These Charitable Trusts are also known as Private Ancillary Funds (PuAF).

Both of the Patricia Holdings Charitable Trust Deed documents are suitable for registration with the Australian Charities and Not-for-profits Commission (ACNC).

 3. Child Maintenance Trust Deed

This is a specific Trust set up as the result of a court order. A Trust is established for the dependents of a Bona Fide domestic relationship where a separation occurs. In general, the dependents will be the children of the relationship and the specific court order is documented on the schedule of the Deed.
